IT'S
THE LAW:
The Americans With Disability Act of 1990 is generally very confusing to
commercial property owners, managers and business tenants. Most owners and
managers are aware of the law to some degree, but many times their first
in-depth understanding of the law is after a lawsuit is served against them for
violation of the Americans with Disabilities Act (ADA) for failure to provide
adequate access to their facility.
To make matters worse, businesses are often accused of violating one’s civil
rights and are subject to demands to make costly improvements to their property
(or rented space) and to pay monetary damages. While the federal ADA does not
allow for recovery of monetary damages, California law does. In addition,
California law has made violation of its disability access requirements
violations of the state’s civil rights laws.

Aaron Asphalt Inc. Offers Turn-Key ADA
Upgrade Program
Aaron Asphalt Inc., now offers a complete turn-key solution to Americans
with Disabilities Act (ADA) upgrades for large shopping centers and commercial
real estate holdings.
In the past, a property owner or manager would have to find competent design,
permitting, project management and construction talent, each with ADA knowledge
and expertise and somehow get them to work together to successful and compliant
completion.
Aaron Asphalt Inc.now brings together all of the elements necessary for a
successful ADA upgrade project under one roof and offers a two-phased,
design-build product.
PHASE 1
Under a preliminary agreement Aaron Asphalt, Inc. accomplishes the following:
PRELIMINARY EVALUATION
Aaron Asphalt, Inc. will evaluate the site for Architectural barriers and deficiencies in
compliance with the American’s With Disabilities Act (ADA) that impede access to
the property by individuals with physical disabilities including:
Access from Public Transportation
Parking
Parking Spaces and Aisles
Van Access
Parking Signage
Passenger Loading Zone
Exterior Paths of Travel
Curb Ramps
Protruding Objects
Exterior Ramps
Exterior Stairs
Hand Rails
Entrance Signage
PRELIMINARY ESTIMATE
Aaron Asphalt, Inc. will then prepare, for the Owner’s written approval, a preliminary estimate
utilizing area, volume, or similar conceptual estimating techniques. Aaron
Asphalt, Inc.shall
make written recommendations to the Owner.
PHASE 2
OWNER’S ELECTION TO PROCEED
If the Owner elects to proceed with the Project beyond the Preliminary
Design-Build Services provided in this Agreement, the Owner and Aaron Asphalt,
Inc.enter into
an additional agreement for the completion of the design and the construction of
the Project.
If the Owner elects not to proceed with the Project, the Owner shall have no
further obligation to Aaron Asphalt, Inc. other than to pay for the preliminary work and to
indemnify Aaron Asphalt, Inc. if the Owner chooses to otherwise use the documents.
PROCEEDING WITH THE DESIGN-BUILD AGREEMENT
DESIGN
If the complexity demands, Aaron Asphalt, Inc. will retain a competent Architect
with solid experience with ADA projects to complete the design and work with the
permitting authority to get the project approved.
PROJECT MANAGEMENT
Aaron Asphalt, Inc. will assign an in-house project manager tasked with bringing the project in
on time, true to the design and with minimal disruption to the projects tenants.
The Project Manager will have experience with many ADA upgrade projects and will
also be extremely experienced working in large commercial, retail and industrial
environments.
CONSTRUCTION
Aaron Asphalt, Inc. has in-house concrete, asphalt pave, sealcoat, stripe and signage crews. The
use of in-house crews allows for the ultimate in control by the project manager.
These crews are lead by seasoned, capable foremen with substantial ADA work
experience.
